Sex Offender Registration and Information

According to Penal Code ¤ 290.01, registration of sexual offenders, convicted sexual offenders are required to register with university police under Section 290 if any one of the following is true:

  • Residing on the 91ÁÔÆæ campus.
  • Enrolled as a student of 91ÁÔÆæ.
  • Employed by 91ÁÔÆæ, either full-time or part-time (includes paid employees or volunteers).
  • Working or carrying on a vocation at 91ÁÔÆæ (i.e. contractors) for more than 14 days, or for an aggregate period exceeding 30 days in a calendar year (paid workers as well as volunteers).

Any persons listed above must register with UPD within 5 business days of commencing enrollment or employment with 91ÁÔÆæ. Registrants are also required to notify UPD within 5 days of ceasing to be enrolled or employed, or ceasing to carry on a vocation at 91ÁÔÆæ.

91ÁÔÆæ Compliance with Megan's Law

In strict compliance with the provisions of  (Sections 290 and 290.4 of the California Penal Code), UPD releases information about threats to the safety of the campus community from serious and high risk sex offenders on or near 91ÁÔÆæ.

UPD may make notification to any of the following persons, agencies or organizations the offender is likely to encounter, including, but not limited to, the following:

  • San José Police Department
  • Santa Clara County Sheriff's Office
  • Other local, state and Federal law enforcement agencies (such as the Santa Clara County Sexual Assault Investigators Association, the California Sexual Assault Investigators Association and the Sexual Habitual Offender Program)
  • Public and private educational institutions
  • Day care establishments
  • Locations that primarily serve individuals likely to be victimized by an offender
  • Other community members at risk

UPD may provide any of the following information regarding a sex offender living within our concurrent jurisdictional area to any of the persons, agencies or organizations authorized to receive information:

  • The offender's full name
  • The offender's known aliases
  • The offender's gender
  • The offender's race
  • The offender's physical description
  • The offender's photograph
  • The offender's date of birth
  • Crimes resulting in registration under 290 PC
  • The offender's address, which must be verified prior to publication
  • Description and license plate number of offender's vehicles (or vehicles the offender is known to drive)
  • Type of victim targeted by the offender
  • Relevant parole and probation conditions, such as one prohibiting contact with children
  • Dates of crimes resulting in classification under this section
  • Date of release from confinement

Note: Information disclosed will not include information that would tend to identify the victim.
